The Confidential Information and all copies thereof shall be returned by Party B to Party A or its affiliates within seven days of a written request for such return, or destroyed accordingly in accordance with the instructions of Party A, provided that the Party B shall be permitted to retain copies if and to the extent required by any applicable law to retain copies. 若甲方或其关联方发出通知要求返还或销毁机密信息，乙方应在收到书面要求返还的通知后7日内将保密信息及其一切复制品返还给甲方或其关联方，或按照指示进行销毁；但若依照适用的法律规定，乙方可保留相应复制品的条件下，其可保留相应的复制品。
Party B shall indemnify and hold Party A and its affiliates harmless against any loss and damages incurred if any provisions of this Agreement is breached. Specifically the compensation payable to Party A or its affiliates in the event of such breach shall be the higher of the loss incurred by Party A or its affiliates including any anticipated profits, or any commercial gains derived by Party B as a result of such breach.
